THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Note: This Notice applies to protected health information (PHI) related to treatment services provided by Arise Treatment Homes, LLC, doing business as Invigorate Behavioral Health. For information about how we handle non-PHI and marketing communications, please review our Privacy Policy.
1. Confidentiality of Health Information
Health information that Arise Treatment Homes, LLC receives and/or creates about you relating to your past, present, or future health, treatment, or payment for health care services is “protected health information” under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R. Parts 160 and 164.
The confidentiality of alcohol and drug abuse treatment records maintained by Arise Treatment Homes, LLC is protected by federal law, 42 C.F.R. Part 2 (the Alcohol and Other Drug Confidentiality Law). Generally, Arise Treatment Homes, LLC may not disclose to persons outside our organization that you are a client or disclose any information identifying you as an individual with a substance use disorder, except as permitted by federal law. Your health information is further protected by California state law when more protective than federal law.
2. Pledge Regarding Health Information
Arise Treatment Homes, LLC understands that health information about you is personal. We are committed to protecting your health information. To provide quality service and comply with legal requirements, we create records of the services you receive. This Notice of Privacy Practices (the “Notice”) applies to all records of your care generated by Arise Treatment Homes, LLC.
This Notice explains how we may use and disclose your protected health information, describes your rights, and outlines our obligations. Arise Treatment Homes, LLC is required by law to:
- Maintain the privacy of your health information
- Provide you this Notice of our legal duties and privacy practices
- Follow the terms of this Notice currently in effect
- Notify you of any unauthorized use or disclosure of your unsecured health information
3. Who is Bound by this Notice
This Notice describes Arise Treatment Homes, LLC’s practices and those of our staff, volunteers, and personnel involved in your care. All will follow the terms of this Notice and may use or disclose your protected health information as permitted or required by law.
This Notice describes your rights to access and control your protected health information. Your personal physician may have separate policies and their own Notice of Privacy Practices.
4. How Arise Treatment Homes, LLC May Use and Disclose Your Protected Health Information
We collect health information about you and store it in your medical record (chart, computer, and/or personal health record). The medical record is Arise Treatment Homes, LLC’s property, but the information belongs to you. The following categories describe how we may use or disclose your protected health information. Some information, such as substance use disorder records, HIV information, and mental health information, receives special protections.
4.1 For Internal Communications
Your protected health information will be used within Arise Treatment Homes, LLC among staff who need the information for your diagnosis, treatment, or referral. This includes:
- Consultations between providers regarding your care
- Billing activities to receive payment for services
- Quality improvement discussions about treatment effectiveness
Your information will not be re-disclosed except as permitted in this Notice.
4.2 To Qualified Service Organizations and Business Associates
We may disclose your protected health information to outside organizations that assist us in providing healthcare, such as:
- Billing companies
- Data processing companies
- Administrative or specialty service providers
We require these organizations to protect your health information through written agreements imposing the same standards we follow.
4.3 In Medical Emergencies
Your health information may be disclosed to medical personnel in emergencies when there is an immediate threat to health and immediate medical intervention is required.
4.4 To Researchers
Under certain circumstances, we may use and disclose your protected health information for research purposes. All research projects must be approved by an Institutional Review Board or privacy review board that has established protocols to ensure your privacy.
4.5 To Auditors and Evaluators
We may disclose protected health information to regulatory agencies, funders, third-party payers, and peer review organizations that monitor programs to ensure regulatory compliance and proper accounting and disbursement of funds.
4.6 Pursuant to Authorizing Court Order
We may disclose your protected health information pursuant to a court order that follows specific application procedures to protect your identity and makes certain determinations as outlined in federal regulations.
4.7 Crime on Arise Treatment Homes, LLC Premises or Against Personnel
We may disclose limited protected health information to law enforcement when a client commits or threatens to commit a crime on our premises or against our personnel. Federal law does not protect information about crimes committed at our facility or against our staff.
4.8 Reporting Suspected Child Abuse and Neglect
We may report suspected child abuse or neglect as mandated by California state law. Federal law does not protect information about suspected child abuse or neglect from being reported to appropriate authorities.
4.9 As Required By Law
We will disclose protected health information as required by state law in a manner permitted by federal privacy and confidentiality regulations.
4.10 Appointment Reminders
We reserve the right to contact you, in a manner permitted by law, with appointment reminders or information about treatment alternatives and health-related benefits appropriate for you.
4.11 Other Uses and Disclosures
Other uses and disclosures not covered by this Notice will be made only with your written authorization or that of your legal representative. You may revoke any authorization at any time, except to the extent we have already taken action relying on it.
5. Your Rights Regarding Your Health Information

5.1 Right to Inspect and Copy
You have the right to inspect and receive copies of your health information that we maintain about you. In limited circumstances authorized by law, we may deny your request. You will be notified of any denial. Some denials are reviewable, and you will be notified of review procedures. Other denials are not reviewable by law.
5.2 Right to Amend Your Health Information
If you believe your protected health information is incorrect or incomplete, you may request an amendment. We may deny your request if it is not in writing, lacks supporting reasons, or if we believe the information is:
- Accurate and complete
- Not created by us (unless the creator is no longer available)
- Not part of the information we maintain
- Not part of information you would be permitted to inspect and copy
If denied, you will receive notification and instructions on submitting a written statement of disagreement and requesting that your amendment request and our denial be maintained with your records.
5.3 Right to an Accounting of Disclosures
You have the right to receive a list of certain disclosures we have made of your protected health information. This list will not include disclosures made for treatment, payment, or health care operations; pursuant to your authorization; or made directly to you.
5.4 Right to Request Restrictions
You may request restrictions on the protected health information we use or disclose about your treatment, payment, or health care operations. While we will consider your request, we are not required to agree to it. If we agree, we will comply except in emergency situations where the information is needed for emergency treatment. We will not agree to restrictions on uses or disclosures that are legally required or which we reasonably believe are in your best health interest.
5.5 Right to Request Confidential Communications
You may request that we communicate with you about your protected health information in a specific way or at a specific location (e.g., only contact you at work or by mail). We will accommodate all reasonable requests.
5.6 Right to File a Complaint
Violation of federal law and regulations is a crime. Suspected violations may be reported to appropriate authorities. If you believe your privacy rights have been violated, you may:
- Contact our HIPAA Privacy Officer in person or by mail at the address above
- File a written complaint with the U.S. Department of Health and Human Services
You will not be penalized or retaliated against for filing a complaint.
5.7 Right to Receive a Copy
You have the right to obtain a copy of this Notice.
6. Changes to This Notice
Arise Treatment Homes, LLC reserves the right to change the terms of this Notice at any time. We reserve the right to make the revised notice effective for protected health information we already have about you as well as any information we receive in the future. We will post a copy of the current Notice on our website. The Notice will contain an effective date.
